Rygate LLC sells drawings for reference only. These are copies of the manufactures original drawings and are not updated. Rygate LLC is not liable and/or responsible for damage and/or injury and/or death caused by these machines or their use thereof. Owners of these machines are responsible to keep their machinery updated in accordance with all OSHA standards as well as all other applicable safety regulations required on machine location. Owners should consult with their respective safety regulators and/or officials if there are any questions about the safety requirements for their machinery.
NOTE: All Bushings and machined parts will be provided machined to original specifications. If machining stock is required it must be requested in writing with purchase order. All non-stock parts are non-returnable unless otherwise authorized. A 50% restocking charge applies to all stock items. If authorization is given to return a non-stock item, restocking charge shall be at Rygate LLC's discretion.
TERMS & CONDITIONS: Buyer acknowledges that the goods covered by quotations or invoices are neither designed nor manufactured by seller. As seller does not know of the specific application of the equipment by buyer, buyer acknowledges that it is buyer's responsibility to provide proper safety devices and equipment for the intended application or use, so as to protect others from harm, and to comply with all federal, state and local government laws, rules and regulations relating to safety and all industry standards.
STANDARD TERMS & DISCLAIMER: Buyer agrees to indemnify, hold harmless and defend seller from and against any and all claims, liabilities or lawsuits arising out of the use of, or in any way involving injury and/or accident and/or death and/or damage occasioned by said equipment and/or accessories. Said agreement includes, but is not limited to, the duty to indemnify, hold harmless and defend seller in any of the following situations: claims involving or alleging improper or negligent design, maintenance, construction, reconstruction, repair, alteration or modification of the equipment by seller, its agents or employees; claims involving or alleging breach of any implied warranty of merchantability, fitness for purpose, or safety of the equipment; claims involving allegations of failure negligent or otherwise, on the part of the seller to equip said equipment with safety devices as required by federal, state or local government statutes, rules or regulations, or as is customary in the trade; and claims involving or alleging negligence by seller, either alone or jointly with buyer or any other person, firm or organization. Buyer specifically agrees to indemnify, hold harmless and defend seller from any and all claims alleging negligence on the part of the seller and waives benefit of any laws, rules or regulations contrary to, or in limitation of, this agreement. The covenants expressed herein shall be severable, and the invalidity, now or in the future of any of the covenants recited herein shall not affect the validity of the remaining covenants.
